The trial court clearly held that the defendants miserably failed to conclusively prove their weak defense of fraud and misrepresentation. Aggrieved by this adverse decision, the defendants have preferred the present appeal before this Court.
The learned senior counsel representing the appellants vehemently argued that the trial court completely ignored the glaring discrepancies deeply embedded in the oral testimony of the two independent attesting witnesses who were examined during the rigorous cross examination process. He further submitted that the plaintiff totally failed to effectively prove his actual financial capacity to immediately pay the massive balance consideration, which is a mandatory statutory requirement under the Specific Relief Act. Conversely, the learned advocate appearing for the respondent successfully supported the impugned decree, highlighting that the registered document naturally carries a very strong legal presumption of validity which strictly cannot be easily rebutted by mere vague oral assertions. We have meticulously revaluated the entire evidentiary record and critically analyzed the rival legal submissions. The equitable remedy of specific performance remains highly discretionary under our legal civil system.
