This contempt petition has been instituted under the provisions of the Contempt of Courts Act, alleging intentional and willful disobedience of the final judgment and order passed by this Hon'ble Court. The petitioner herein was working as a daily wage employee in the respondent municipal corporation for more than two continuous decades. In the original writ petition, a detailed categorical direction was issued by the learned Single Judge commanding the respondent municipal commissioner to regularize the employment of the petitioner. The court had granted a specific time limit of eight weeks to complete the necessary administrative formalities and disburse all consequential financial benefits. However, despite the clear mandate of this Court and the subsequent service of multiple legal notices by the advocate of the petitioner, the respondents deliberately failed to comply with the judicial directions. Aggrieved by this sheer administrative apathy and complete inaction, the present contempt proceedings were initiated to uphold the majesty of law.
In response to the show cause notice issued by this Court, the respondent commissioner filed a personal affidavit tendering an unconditional apology for the substantial delay. The learned senior counsel appearing for the corporation submitted that the delay was purely administrative and unintentional, caused due to the pending approval from the state finance department. It was vehemently argued that there was absolutely no deliberate intention to undermine the authority of this Court. Conversely, the learned counsel for the petitioner strongly opposed the hollow apology, contending that the respondents have developed a habitual tendency to ignore binding judicial orders until the threat of contempt looms large.
We have carefully perused the affidavit in reply and heard the extensive submissions. The defense of administrative procedural delay cannot be accepted as a valid justification for violating a time bound judicial mandate. The conduct of the respondent clearly demonstrates a lackadaisical approach towards the binding orders of the constitutional court, which strikes at the very root of the rule of law. However, considering the fact that the actual regularization order has now been finally issued during the pendency of these proceedings, we are taking a lenient view in this specific matter. The unconditional apology is hereby accepted, but the respondent is strictly warned to be extremely careful in the future. The contempt petition is accordingly disposed of, directing the corporation to pay a cost of rupees ten thousand to the petitioner today itself without any further delay whatsoever.
