This first appeal is directed against the judgment and award passed by the learned civil judge senior division in a land acquisition reference filed under section eighteen of the Land Acquisition Act. The acquiring body has preferred this present appeal contending that the reference court committed a manifest error in relying upon sale instances of small developed plots to determine the market value of large agricultural tracts. The government pleader argued that suitable deductions towards development charges ought to have been strictly applied by the learned trial judge before calculating the final payable amount. On the contrary, the advocate representing the farmers supported the impugned judgment, highlighting that the acquired property was situated adjacent to a national highway and possessed immense non agricultural potential.
We have carefully revaluated the entire evidence adduced on record by both the contesting parties. The core principle for determining fair compensation is to ascertain the price which a willing purchaser would pay to a willing seller in the open market on the date of the preliminary notification. Considering the prime geographical location, excellent soil quality, and abundant water availability, the enhancement granted by the lower court appears to be perfectly just, highly reasonable, and well founded. We find absolutely no valid grounds to interfere with the well reasoned judgment under challenge. Consequently, the appeal is dismissed being completely devoid of any legal merit. The acquiring body is hereby directed to immediately deposit the entire balance compensation amount along with statutory interest into the registry of this Court within a strict period of eight weeks from today without any further unjust delay.
