🏛️ Mock Test 6: Motor Accident Claims Tribunal (MACT)
This appeal is directed against the judgment and award passed by the Motor Accident Claims Tribunal, whereby a compensation of rupees fifteen lakhs was awarded to the claimants. The unfortunate incident occurred on the tenth of May when the deceased was traveling on his motorcycle towards his workplace. A heavy goods vehicle, driven in a rash and negligent manner, came from the opposite direction and dashed against the motorcycle. Due to the severe impact of the violent collision, the deceased sustained multiple grievous injuries and succumbed to them on the spot. The claimants, being the widow and minor children of the deceased, filed a claim petition seeking compensation under section one hundred and sixty six of the Motor Vehicles Act. They asserted that the deceased was solely running a successful transport business and was earning a monthly income of rupees fifty thousand. To substantiate their claim, they produced the income tax returns and bank account statements of the deceased.
The insurance company resisted the claim petition by filing a written statement, primarily contending that the driver of the offending vehicle did not possess a valid and effective driving license at the relevant time. Therefore, there was a fundamental breach of the terms and conditions of the insurance policy, absolving the company from any liability to pay the compensation. Furthermore, it was argued that there was contributory negligence on the part of the deceased as he was riding the motorcycle without wearing a protective helmet. The Tribunal, after analyzing the oral and documentary evidence, concluded that the accident was caused solely due to the absolute negligence of the truck driver. The Tribunal rejected the defense of the insurance company regarding the invalid license, observing that no independent evidence was adduced to prove the said contention.
In the present appeal, the learned counsel for the insurance company reiterated the same defenses and argued that the quantum of compensation awarded by the Tribunal is highly excessive and exorbitant. On the contrary, the counsel for the claimants supported the award, stating that the Tribunal has rightly calculated the loss of dependency by applying the correct multiplier based on the age of the deceased. We have carefully perused the impugned judgment rendered by the lower court. The law is well settled that the burden of proving a breach of the policy conditions rests entirely upon the insurance company, which they have miserably failed to discharge.
