This application is filed under section thirty four of the Arbitration and Conciliation Act, seeking to set aside the final arbitral award passed by the sole arbitrator. The learned arbitrator, after meticulously conducting the arbitral proceedings and comprehensively analyzing the voluminous documentary evidence, published the final award. The arbitrator dismissed the massive monetary claims raised by the petitioner and allowed the counter claim of the respondent, directing the petitioner to pay outstanding dues along with an interest of twelve percent per annum.
In the present challenge before this commercial court, the learned counsel representing the petitioner argued that the impugned award is patently illegal and squarely conflicts with the fundamental public policy of Indian law. It was emphatically contended that the arbitrator completely ignored vital contractual clauses which explicitly prohibited the contractor from claiming any compensation for delays caused by external administrative factors. Refuting these contentions, the advocate for the respondent maintained that the scope of judicial interference with an arbitral award is extremely limited and circumscribed. The court cannot sit in an appeal over the award or attempt to reappreciate the technical evidence adduced before the tribunal. We have given our anxious consideration to the elaborate rival submissions made by the parties. It is a well established legal doctrine that an arbitrator is the ultimate master of facts and evidence. If the interpretation of the contract adopted by the arbitrator is plausible and highly reasonable, the court must absolutely refrain from substituting its own distinct judicial view over it under any circumstances whatsoever.
