The investigating officer arrested the present appellant on the strong suspicion that he had committed the murder with the clear motive of committing robbery.
To firmly establish the guilt of the accused, the prosecution primarily relied upon the crucial recovery of the stolen gold ornaments and the bloody clothes belonging to the victim at the sole instance of the accused. Furthermore, the prosecution introduced the critical testimony of a local shopkeeper who claimed to have seen the accused hurriedly leaving the vicinity of the farmhouse late at night. The trial court accepted these links as conclusive proof and recorded the finding of guilt. Assailing the said conviction, the learned defense counsel vehemently argued that the chain of circumstantial evidence is completely broken and disjointed. The facts so established must be consistent only with the absolute hypothesis of the guilt of the accused, leaving absolutely no reasonable ground for any other alternative conclusion favoring the accused person in law before passing any final judgment.
