This is an application filed under section four hundred and thirty nine of the Code of Criminal Procedure seeking regular bail in connection with a first information report registered at the local police station. Opposing the bail application, the learned additional public prosecutor contended that the offenses alleged are of a serious and non-bailable nature. The medical certificate of the victim corroborates the version of the prosecution, indicating the brutal nature of the assault. The prosecutor expressed an apprehension that if the applicant is enlarged on bail, he might tamper with the prosecution evidence or intimidate the key eyewitnesses. After carefully considering the submissions advanced by both the sides and upon perusal of the case diary, it appears that the investigation is complete and the trial is likely to take a substantial amount of time to conclude. The fundamental principle of criminal jurisprudence is that bail is the rule and jail is an exception. Keeping the applicant in custody for an indefinite period would amount to a pre-trial punishment. Considering the nature of the allegations, the role attributed to the present applicant, and the fact that the charge sheet is filed, I am inclined to exercise my discretion in favor of granting regular bail, subject to stringent conditions ensuring his presence during the entire ongoing trial proceedings.
