The present writ petition under Article two hundred and twenty six of the Constitution of India has been filed by the petitioner challenging the impugned order of termination issued by the respondent authorities. The petitioner was appointed as a lower division clerk in the administrative department of the state government after successfully clearing a competitive examination and a subsequent typing test. After completing a probationary period of two years to the satisfaction of the superior officers, his services were regularized by a formal office order.
However, after serving for nearly five years, a show cause notice was issued to him alleging gross misconduct, insubordination, and dereliction of duty. The petitioner submitted a detailed reply denying all the charges leveled against him and requested a personal hearing. Disregarding his explanation, the disciplinary authority appointed an inquiry officer to investigate the matter. The petitioner contends that the departmental inquiry was conducted in a highly arbitrary and biased manner, in blatant violation of the principles of natural justice. He was not afforded a reasonable opportunity to cross-examine the prosecution witnesses or to produce defense evidence to vindicate his innocence. The inquiry officer submitted a report finding the petitioner guilty of all the charges, and acting upon the same, the competent authority passed the penalty of dismissal from service. The learned counsel for the petitioner vehemently argued that the impugned order is legally unsustainable as it is based on perverse findings and no reasonable person could have arrived at such a conclusion based on the material available on record. On the other hand, the learned government pleader appearing on behalf of the respondents justified the termination, asserting that the petitioner was a habitual offender with a completely tainted service record.
The respondents maintained that full opportunity was granted to the petitioner during the inquiry proceedings, and the strict rules of the Evidence Act do not apply to departmental proceedings. We have heard the learned advocates for the respective parties and meticulously examined the voluminous documents annexed to the petition. It is a settled position of law that the High Court, in the exercise of its writ jurisdiction, does not act as an appellate authority to reappreciate the evidence adduced before the disciplinary tribunal. The scope of judicial review is strictly limited to examining the decision-making process and ensuring that there is no procedural irregularity or a complete breach of a mandatory statutory service rules.
