This application under section four hundred and thirty eight of the Code of Criminal Procedure is filed by the applicant seeking pre arrest bail in connection with an alleged offense of cheating and criminal breach of trust. The entire prosecution case is heavily and entirely based on a formal written complaint filed and lodged by the original informant, alleging that the applicant had induced him to invest a huge sum of rupees twenty lakhs in a fictitious housing scheme. It is further alleged that the applicant had promised to allot a residential flat in the proposed scheme within three years. However, the applicant neither constructed the building nor returned the invested amount, thereby misappropriating the funds for his personal wrongful gain.
The learned counsel representing the applicant submitted that the dispute between the parties is purely civil and commercial in nature, arising out of a regular business transaction. He pointed out that the informant has already instituted a parallel civil suit for the specific performance of the contract and for the recovery of the money. It was vehemently argued that the criminal machinery is being misused as a tool to exert undue pressure and extract monetary extortion from the innocent applicant. Furthermore, the counsel emphasized that the entire case is based on documentary evidence which is already in the custody of the investigating authorities, and therefore, no custodial interrogation of the applicant is strictly warranted. The applicant is a reputed builder having deep roots in society and is completely willing to cooperate with the ongoing investigation process.
Opposing the application, the learned additional public prosecutor contended that the applicant is a habitual offender involved in multiple similar cases of organized financial frauds across the state. The prosecutor argued that granting anticipatory bail would severely hamper the crucial investigation, as the police need to unearth the complex money trail and recover the defrauded amount. I have carefully examined the case diary and the rival contentions raised by both the sides during this final hearing. The power to grant anticipatory bail is highly extraordinary in character and must be exercised sparingly in exceptional cases. Considering the gravity of the economic offense, the massive magnitude of the fraud, and the strong prima facie material available on record against the present applicant, I do not find this to be a fit case to exercise my discretionary jurisdiction initial stage of the police investigation today.
