This writ petition is filed under Article two hundred and twenty six of the Constitution of India challenging the arbitrary cancellation of the admission granted to the petitioner in the prestigious government medical college. It was submitted that the submission of a flawless certificate before the prescribed cut off date is an absolute prerequisite to claim the vital reservation benefits.
We have carefully perused the relevant records and the applicable statutory guidelines governing the centralized admission process. It is an undisputed fact that the petitioner fundamentally belongs to the eligible reserved category and his genuine social status is not under any serious doubt. Depriving a meritorious candidate of higher medical education merely on hyper technical grounds would cause grave and irreparable loss to his promising future career. Therefore, we quash and set aside the impugned termination order and hereby direct the respondents to immediately restore the admission of the petitioner without demanding any additional financial penalty. The university shall also permit him to peacefully appear for the upcoming first semester practical and written examinations scheduled next month to secure his academic year fully and an unconditionally today itself.
