🏛️ Mock Test 5: Family Court Appeal (Divorce & Cruelty)
The present family court appeal is filed by the appellant husband challenging the decree of divorce granted in favor of the respondent his wife by the learned principal judge of the family court. The wife had filed a petition seeking dissolution of their marriage on the grounds of cruelty and desertion under the provisions of the Hindu Marriage Act. The marriage between the parties was solemnized according to Hindu Vedic rites and customs at Mumbai. Out of this wedlock, they have one minor daughter who is currently in the custody of the mother. The wife alleged in her petition that shortly after the marriage, the husband and his family members started subjecting her to severe mental and physical agony. She was constantly humiliated for bringing insufficient dowry and was frequently taunted regarding her educational background. She further claimed that the husband was addicted to alcohol and would often assault her brutally under the influence of liquor. Unable to bear the continuous domestic violence, she was forced to leave the matrimonial home and take shelter with her aging parents.
Conversely, the husband filed a detailed written statement denying all the allegations of cruelty and harassment. He counter-alleged that the wife was highly arrogant, short-tempered, and refused to perform any household chores. He stated that she deserted him without any reasonable cause and deprived him of his conjugal rights. The family court, after recording the oral testimony of both the spouses and examining the documentary evidence, concluded that the wife successfully proved the ground of cruelty. The court also directed the husband to pay a monthly maintenance of rupees twenty thousand for the welfare of the minor child.
In this appeal, the learned counsel for the husband forcefully argued that the minor wear and tear of married life cannot be equated with cruelty. It was submitted that the trial court heavily relied upon the uncorroborated testimony of the wife while completely discarding the evidence of the husband. The counsel appearing for the respondent wife supported the impugned decree, pointing out that the medical reports clearly proved the physical assaults inflicted upon her. After hearing the extensive arguments, we are of the firm opinion that the institution of marriage is built upon mutual trust, respect, and understanding. The continuous course of abusive conduct by the husband has completely destroyed the foundation of the marriage, making it impossible for the wife to live safely.
