This criminal revision application is preferred against the judgment and order of conviction passed by the learned judicial magistrate first class, which was later confirmed by the sessions court in an appeal. The applicant convicted for the commission of an offense punishable under section one hundred and thirty eight of the Negotiable Instruments Act. The original complainant alleged that he had advanced a friendly loan of rupees five lakhs to the applicant for his urgent business requirements. In order to discharge this legally enforceable debt, the applicant issued a post-dated cheque drawn on a nationalized bank. When the complainant presented the said cheque for encashment through his banker, it was returned unpaid with an endorsement stating that the funds in the account were insufficient. A statutory legal notice was promptly issued to the applicant through a registered post, demanding the payment of the cheque amount within fifteen days from the date of the receipt of the notice.
Despite receiving the notice, the applicant failed to remit the amount, thereby compelling the complainant to institute a criminal complaint. The trial court recorded the statement of the complainant and marked the original cheque, the return memo, and the legal notice as exhibits. The defense raised by the applicant was that the cheque in question was given merely as a security for a completely different transaction and that it was misused by the complainant to extort money. However, the applicant chose not to step into the witness box or examine any defense witness to substantiate his claim. The trial court concluded that the statutory presumptions under the Act were completely in favor of the complainant and the applicant failed to rebut the same even by a preponderance of probabilities. The appellate court concurred with the findings of the trial magistrate and dismissed the appeal.
In this revision petition, the learned counsel for the applicant argued that the complainant failed to prove his financial capacity to lend such a massive amount and therefore, the existence of a legally enforceable debt was highly doubtful. The counsel further submitted that the courts below misdirected themselves in placing the entire burden of proof upon the accused. We have carefully scrutinized the concurrent judgments of the courts below. The revisional jurisdiction of this Court is extremely limited and cannot be invoked to merely reweigh the evidence unless the findings are manifestly illegal, irregular, or suffer from jurisdictional error.
